Before using our Service, please read these Terms carefully.
Definitions and Interpretation of Terms
Interpretation
The following definitions shall have the same meaning regardless of whether they appear in singular, dual, or plural form.
Definitions
For the purposes of these Terms, the following terms shall have the following meanings:
· Application means the software named EXTREME TRAINING provided by the Company and downloaded onto any electronic device.
· App Store means the digital distribution service operated and managed by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) from which the Application was downloaded.
· Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.
· Company (referred to in these Terms as either "the Company", "we", "us" or "our") refers to Extreme Corporation d.o.o., Sermin 75k, SI6000 Koper.
· Country means Slovenia.
· Device means any device that can access the Service such as a computer, a mobile phone, or a digital tablet.
· Promotions means contests, sweepstakes, or other promotions offered through the Service.
· Service means the Application.
· Membership means access to the Service or services provided to you by the Company on a subscription basis.
· Free Trial means a limited period of time that may be free when purchasing a subscription.
· Terms means these terms and conditions that form the entire agreement between you and the Company regarding the use of the Service.
· Third-party Social Media Service means any services or content (including data, information, products, or services) provided by a third party that may be displayed, included, or made available through the Service.
· You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.
Confirmation
These are the Terms governing the use of this Service and the agreement between you and the Company. These Terms set out the rights and obligations of all users in connection with the use of this Service.
Your access to and use of the Service are conditional on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access the Service.
You represent that you are over 18 years old. The Company does not permit persons under 18 years of age to use the Service.
Your access to and use of the Service are also conditional on your acceptance of and compliance with the Company’s Privacy Policy. Our Privacy Policy describes our guidelines and procedures regarding the collection, use, and disclosure of your personal data when using the Application or website, as well as your privacy rights. Please read our Privacy Policy carefully before using our Service.
Membership Fee
Membership Period
The Service or its parts are available only with a paid membership fee. Depending on your membership choice at purchase, the Company will regularly and in advance send you invoices (daily, weekly, monthly, or yearly basis).
Your membership fee will automatically renew at the end of each period under the same terms unless you cancel it or the Company cancels it.
Cancellation of Membership
You can cancel the renewal of your membership either in your account settings or by contacting the Company. Already paid membership fees for the current period will not be refunded, so you will have access to the Service until the end of that period.
Invoices
You must provide the Company with accurate and complete billing information, including your full name, address, country, postal code, telephone number, and valid payment method details.
If automatic billing does not work for any reason, the Company will issue you an electronic invoice, which you must pay in full by the due date, with the invoice amount corresponding to the billing period indicated on the invoice.
Membership Fee Changes
The Company may, at its discretion, change the membership fee at any time. Any membership fee change will take effect at the end of the then-current membership period.
The Company will provide you with reasonable prior notice of any membership fee change so that you can cancel your subscription before the change takes effect.
Your continued use of the Service after the membership fee change takes effect constitutes your agreement to pay the modified membership fee amount.
Refunds
Paid membership fees are non-refundable, except as required by law.
The Company may consider certain requests for membership fee refunds on a case-by-case basis, at its sole discretion.
Free Trial Period
The Company may, at its sole discretion, offer a subscription with a limited free trial period.
The Company may require your billing information to enroll in the free trial period.
If you enter your billing information when enrolling in the free trial period, the Company will not charge you any membership fee until the free trial period expires. The membership fee for the selected membership type will be automatically charged on the last day of the free trial period unless you cancel your membership.
The Company reserves the right to change the Free Trial Period Terms or discontinue the free trial offer at any time without prior notice.
Promotions
All promotions offered within the Service may be governed by separate rules and not these Terms.
If you participate in such promotions, please review the applicable rules and our Privacy Policy. If the promotion rules conflict with these Terms, the promotion rules shall prevail.
Intellectual Property
The Service and its original content (excluding content provided by you or other users), features, and functionality are and will remain the exclusive property of the Company and its licensors.
The Service is protected by copyright, trademark, and other laws of Slovenia and foreign countries.
Our trademarks and company clothing must not be used with any product or service without the prior written consent of the Company.
Links to Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by the Company.
The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Company shall not be held liable for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such products, goods, or services available on or through any such websites or services.
We strongly recommend that you read the terms and privacy policies of any third-party websites or services that you visit.
Termination
If you violate these Terms, we may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation.
Your right to use the Service will cease immediately upon termination.
Limitation of Liability
Regardless of any damage you may suffer, the entire liability of the company and its suppliers under all provisions of these Terms as well as your exclusive legal remedy related to the foregoing shall be limited to the amount you actually paid through the service or €100 if you have not purchased anything through the service.
To the fullest extent permitted by applicable law, the company or its suppliers shall in no event be liable for any special, incidental, direct, or consequential damages (including, but not limited to, damages or loss of profit, loss of data or other information, business interruption, bodily injury, loss of privacy arising from use or inability to use the service or in connection therewith, third-party software or hardware you use with the service, or any damages otherwise related to any provision of these Terms), even if the company or its supplier has been advised of the possibility of such damages and even if the legal remedy fails of its essential purpose.
Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply to you. In those jurisdictions, the liability of each party shall be limited to the greatest extent permitted by law.
“AS IS” and “AS AVAILABLE” Disclaimer
The service is provided “AS IS” and “AS AVAILABLE”, without any warranty of any kind, either express or implied. To the fullest extent permitted by applicable law, the company, on its own behalf and on behalf of its subsidiaries, licensors, and service providers, expressly disclaims all warranties, express or implied, statutory or otherwise, including but not limited to all implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement, and all warranties that may arise from course of dealing, course of performance, or trade usage. Without limiting the foregoing, the company does not warrant or make any representations regarding the service meeting your requirements, achieving any intended results, being compatible or working with any other software, applications, systems, or services, operating without interruption, achieving performance or reliability standards, being error-free, or that any errors will be corrected.
The company and its providers make no representations or warranties, express or implied, including but not limited to: regarding the operation or availability of the service or the data, content, and materials or products included in the service; that the service will operate uninterrupted or error-free; regarding the accuracy, reliability, or timeliness of any data or content available through the service; that the service, its servers, content, or emails sent by or on behalf of the company are free of viruses, scripts, Trojan horses, malware, time bombs, or other harmful components.
Some jurisdictions do not allow the exclusion of certain types of warranties or the limitation of applicable consumer statutory rights, so some or all of the above exclusions and limitations may not apply to you. In such jurisdictions, these disclaimers and limitations shall apply to the maximum extent permitted by applicable law.
Governing Law
These Terms and your use of the service are governed by the laws of Slovenia, without regard to its conflict of law rules. Your use of the application may also be subject to other local, state, national, or international laws.
Dispute Resolution
If you have any concerns or disputes regarding the service, you agree to first attempt to resolve them informally by contacting the company.
For Users in the European Union (EU)
If you are a user in the European Union, you will benefit from all mandatory provisions of the laws of the country in which you reside.
End User Provisions in the USA
If you are a user in the USA, our service is considered a “commercial item” within the meaning of 48 C.F.R. Section 2.101.
Compliance with US Law
You represent and warrant that you do not reside in a country subject to a U.S. embargo or that has been designated by the U.S. government as a “terrorist supporting country,” and that you are not listed on any U.S. government list of prohibited or restricted parties.
Severability and Waiver
Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Translation Interpretation
These Terms may have been translated. You agree that in the event of a dispute, the Slovenian version shall prevail.
Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Service.
Online Store
PURCHASE PROCESS
When you select a product you wish to purchase, add it to the shopping cart by clicking the “add to cart” button. The cart icon is located in the top right corner. If you hover over or click on it, the contents of the cart will be displayed, showing the collected products (image, description, and product price). In the cart, before completing the purchase, you can change the quantity of the product(s) or remove individual products from the cart.
You do this as follows: if you want to increase the number of selected products, press the “+” sign, if you want to decrease the number of selected products, press the “-” sign, and if you want to remove a specific product from the cart, press the “x” sign.
You can then continue shopping and adding products or proceed to checkout.
When you have selected all the products and checked in the cart that you have the correct items, continue by clicking on checkout. In this step, you enter your personal details if you are shopping as a guest. Customers who have previously registered in our system will have their data auto-filled when logging in again with their password.
If you wish, after entering your data, you can also choose delivery to a different address. You do this by clicking on the text “DELIVER TO A DIFFERENT ADDRESS?” Then enter the name and address where you want the order delivered.
In the next step, select the payment method by clicking, and before finalizing the order, check all entered data (personal information, delivery address, selected products and their quantities, payment method) to ensure correctness. The customer is responsible for the accuracy of the entered data.
Before completing the order (button BUY NOW), confirm by clicking the terms and conditions and privacy policy, after reading:

• I have read and fully agree with the privacy policy
To complete the purchase, press the BUY NOW button. The online store automatically generates the order and sends an email with order details (products, prices, quantities, user information…) to the email address you entered. This confirms the order, and the products will be shipped as soon as possible. If the delivery time is more than 2 working days, the provider will notify the customer.
By completing the order, you commit to receiving the ordered items, and a copy of the order will be sent to your email. Submitting your order therefore binds you to its payment.
ORDER CANCELLATION
Order cancellation is possible within 1 hour after placing the order, or until 12:00 (applies to orders placed just before 12:00). After this time, the packages are handed over to the delivery service and in most cases arrive at the recipient already on the next working day.
PAYMENT
The provider sends the invoice to the customer in PDF format to the customer's email address. The user pays with payment cards, via PayPal, or by proforma invoice to a bank account (applies to Slovenia).
The invoice includes an itemized list of the price and any costs related to the purchase, as well as information about the right to withdraw from the contract. The buyer is obliged to verify the correctness of the data before placing the order.
DELIVERY TIME
For products in stock, goods are dispatched within 1–2 working days. In the case of a longer delivery time, we will inform you by email or by phone.
DELIVERY
The provider must deliver the goods or service within the promised time. Upon delivery, the user must also be provided with additional information regarding the right of withdrawal, especially the conditions and manner of exercising this right. All necessary information must be provided regarding the address where the user can file a complaint and information on warranties and servicing or other services after the conclusion of the contract.
Shipping is always paid by the product purchaser. Ordered items are dispatched within 1–2 working days from the order, or from the payment of the proforma invoice. The ordered goods usually arrive at the customer on the next working day, and rarely take longer. Once we process the order and ship it, we notify you via the email address you provided.
Shipments are trackable, so you can contact us by writing to sales@extremetraining.eu if you have not received the package or have been waiting for it for a long time. We will check the status of the shipment.
There are no dispatches during weekends.
Shipping costs for Slovenia amount to:
– EUR 4.50 incl. VAT.
All listed product prices are in EUR and include VAT (value-added tax).
We use Pošta Slovenije, GLS, DPD for order deliveries.
Delivery:
Ordered products are delivered to the address you entered as the delivery address. Deliveries mostly take place in the morning hours. If you are unable to accept the shipment at the time of delivery, you can later pick it up at the nearest post office, parcel locker, or other pick-up points.
If the shipment is returned to us due to incorrectly entered recipient address data by the customer, additional costs will be incurred, which are the customer’s responsibility.
The costs for resending and dispatching such a shipment to a new address are charged to the customer in the amount of EUR 4.500.
If the customer changes their mind and does not wish for the item to be resent, only the amount paid for the products will be refunded.
Before completing the order, you are informed of the following statement: "By placing the order, the buyer assumes the obligation of payment."
By completing the order, you agree with this statement and receive a copy of the order at your provided email address. Submitting your order thus binds you to its payment.
When selecting the delivery address before completing the purchase, you can also choose delivery to a parcel locker (PS paketomat), petrol station, or post office by clicking the yellow button – "edit delivery".
PAYMENT BY PROFORMA INVOICE FOR SLOVENIA
For the amount of the bank transfer fee when paying by proforma invoice, please inquire with the bank through which you are making the payment.
When paying by proforma invoice, the transaction fee for UPN payment according to the price list of Pošta Slovenije is not charged.
This means you pay the purchase price + shipping cost of EUR 4.50 within Slovenia.

The order paid by proforma invoice is valid for only 3 working days. Accordingly, ITEMS ORDERED VIA PROFORMA ARE RESERVED FOR 3 WORKING DAYS ONLY. After three days, it is considered that you have withdrawn from the purchase, your order is canceled, and the items are returned to sale.
PAYMENT VIA PAYPAL
PayPal offers a simple and above all secure way to pay for orders online.
Your credit card number is not visible to us as the seller.
When paying with PayPal, you can use Visa, Mastercard, American Express, etc.
To start using PayPal, you must create a user account, which is free and provides anonymous, safe, and fast transactions for users.
PAYMENT BY CREDIT CARD
Add the items you wish to purchase to the cart. After completing the order, you will be redirected to the Activa system.
Enter the credit card number and the security code. In the next step, confirm the payment and your purchase is complete. SHIPPING TO CROATIA

The buyer always pays for delivery.
Ordered items are dispatched within 1–2 working days, and usually arrive within 2–3 working days, or 4–5 working days for islands.

DISCOUNT CODES
Discount codes have a limited validity period and can only be used for products at regular prices.
The discount is automatically applied if the code is entered by the customer at the time of placing the order.
Codes are not valid for already discounted products.
It is not possible to apply a discount code retroactively to an order that has already been placed.
Likewise, the code does not apply to orders submitted before the code was entered.
Discount codes, promotions, and other benefits cannot be combined — only one code may be used per order.
Multiple orders with different discount codes cannot be merged into a single order.
Discount codes do not apply to newly selected items that are being exchanged for products ordered in the past.
€5 CREDIT FOR NEWSLETTER SIGN-UP
The €5 credit received upon subscribing to our newsletter can be redeemed only for regularly priced items and does not apply to discounted products.
RIGHT OF WITHDRAWAL FROM THE CONTRACT, RETURNS/EXCHANGES
RIGHT OF WITHDRAWAL
The consumer has the right to withdraw from the contract within fourteen (14) days without providing any reason. The withdrawal period is fourteen days from the date you or a third party (other than the carrier) specified by you received the ordered goods.
You may notify the company of your decision to withdraw either by completing the form available at the link "WITHDRAWAL FROM CONTRACT" or by sending a clear and unambiguous statement indicating your intent to withdraw (as per Article 43.db of the Slovenian Consumer Protection Act – ZVPot). This statement can also be submitted via email at info@extremetraining.eu.
Your withdrawal is considered timely if the notification or return shipment is sent within the withdrawal period. The only cost incurred by the consumer in connection with the withdrawal is the direct return shipping cost. The goods must be returned to the company no later than 14 days after giving notice of withdrawal.
The items must be unused, undamaged, and returned in their original packaging with all accompanying documents. Otherwise, the consumer may be held liable for any decrease in the value of the goods resulting from handling that was not necessary to determine their nature, characteristics, and functioning.
If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than 14 days from the day we are informed of your decision to withdraw.
Return shipping costs are borne by the customer.
We may withhold reimbursement until we have received the returned goods.
The refund will be made using the same payment method used by the consumer for the original transaction, unless the consumer has expressly agreed otherwise and incurs no additional fees for such a refund.
The consumer may inspect and test the goods only to the extent necessary to determine their nature, characteristics, and functioning — as typically permitted in physical stores. Any testing or use beyond this may be considered use, and the consumer is liable for any value reduction caused by such handling.
If a package is returned at the company’s expense or sent with cash on delivery, the company will refuse acceptance. All return shipping costs are borne by the customer.
PRODUCT EXCHANGE
If you wish to exchange an item for another, please fill out the RETURN FORM.
Return shipping to our address is covered by the customer.
Our benefit for you:
We cover the shipping cost of the first exchange (from us to you).
You only pay the cost of sending the item back to us. For any further exchanges, all shipping costs (both ways) are borne by the customer.
Exchanges can be made within 14 days of receiving your package.
We only accept exchanges for products that are unused, unworn, odor-free, unwrinkled, and returned in undamaged original packaging — including all accessories, manuals, decorative materials (if originally included), and tags.
The product label is mandatory and must be returned untouched.
In short, we can only exchange the product if it is exactly as you received it.
Product photos on the website reflect the real products. However, due to differences in display devices (phones, monitors, etc.), color shades may appear differently (lighter/darker). This is outside our control.
If the product color differs from your expectations, you may still return it — the same return conditions apply as stated above.
Items that have been washed, worn, or altered from their original condition cannot be returned, even if you changed your mind.
Returns are only accepted under the "Right of Withdrawal" terms described above.
When exchanging, the original prices listed on your invoice will apply to the returned items.
For newly selected items, the current prices listed in the online store at the time of receiving your return will apply.
Discount codes and coupons cannot be applied during product exchanges.
They are intended for use during new purchases only.
COMPLAINTS
In cases where your delivery is missing accompanying documentation, contains incorrect information on the invoice, or in other similar situations, please contact us at info@extremetraining.eu with a description of the issue. We will provide you with appropriate instructions, clarification, or deliver any missing items as soon as possible.
We advise you to inspect the goods upon receipt. If you notice any defect that does not match the product description on our website, please notify us using the RETURN FORM, where we will coordinate the next steps.
The returned item must be accompanied by its undamaged original packaging and all included accessories (boxes, manuals, plastic packaging, etc.). Packaging is considered part of the product.
If any part of the packaging is torn, damaged, or missing (e.g., cardboard labels, plastic bags), the item will be considered used.
The return shipping cost is borne by the customer.
If you are making a complaint and choose to exchange the item for a different model, the current prices listed in our online store at the time we receive your returned item will apply.
Discount codes or coupons cannot be applied in this type of exchange related to a complaint.
MATERIAL DEFECT
A defect is considered material if:
· The product lacks characteristics necessary for normal use or for resale;
· The product lacks characteristics required for a specific use known to the seller and for which the buyer purchased it;
· The product does not have features or qualities explicitly or implicitly agreed upon or prescribed;
· The seller delivered an item that does not match the sample or model, unless the sample or model was shown for informational purposes only.
The suitability of a product for normal use is assessed based on the standards for goods of the same type and with consideration of any statements made by the seller or manufacturer (especially in advertising, product descriptions, or labeling).
The buyer can assert their rights based on a material defect if they notify the seller within two months from the date the defect was discovered.
The seller is not liable for defects that appear after two years from the date of delivery.
The Consumer Protection Act (Zakon o varstvu potrošnikov) governs the buyer’s right to claim material defects in more detail.
WARRANTY
The buyer may submit a claim for a defect at any time during the warranty period. A warranty can be enforced for products with a mandatory warranty (as listed in the Rules on Goods for Which a Warranty for Faultless Operation Is Issued) and for products covered by a voluntary warranty.
During the warranty period, the consumer may demand that the guarantor remedy the defect free of charge.
If the defect cannot be rectified or is not rectified within 45 days, the consumer may request a replacement product free of charge.
How to claim warranty rights?
The buyer must submit a written request to the guarantor within the warranty period and under the warranty terms, requesting rectification of the defect. The buyer must provide the product, the warranty certificate, and a copy of the purchase invoice.
The buyer incurs no costs for the repair or replacement of the product under warranty.
If the seller determines that the defect resulted from improper handling by the buyer and that the warranty claim is unjustified, the product will be returned to the buyer at the buyer’s expense along with a written explanation.
Unclaimed Orders
Once your order is processed and shipped, you will receive an email notification to the address you provided during checkout.
If the postal service is unable to deliver the parcel, a notice of attempted delivery will be left in your mailbox. You then have 15 days to collect your parcel at your local post office.
If the package is not collected within this time, it will be returned to us.
In case you did not receive the delivery notice, please contact us at info@extremetraining.eu, and we will provide the necessary information for you to pick up the package without the notice slip.
